Seller Information

The seller is WineCellarDesign Sàrl (IDE/UID: CHE-112.278.732), Riant Coteau 7, 1196 Gland, hereinafter referred to as “WineCellar.”

Formation of the Contract

Unless it is expressly designated as an order confirmation, the message automatically generated by WineCellar’s computer system in response to an order placed on the www.eurocave.swiss website constitutes only an acknowledgment of receipt of the order. An order is accepted only once it has been confirmed by WineCellar, either in the form of an order confirmation expressly designated as such, in the form of an offer from WineCellar that has been countersigned by the customer, or through the fulfillment of the order placed by the customer.

Product Availability

The products listed on the www.eurocave.swiss website or in WineCellar’s catalogs are available while supplies last. The information provided on the www.eurocave.swiss website or in WineCellar’s catalogs, brochures, price lists, and product descriptions is for informational purposes only.

Price

The prices listed on the website www.cavepremium.ch and in WineCellar’s catalogs, brochures, flyers, or similar publications are subject to change at any time. Prices are those in effect at the time of order confirmation or, if WineCellar has issued an offer, those specified therein; or, if the order is simply fulfilled by WineCellar, those in effect at that time. If WineCellar issues an offer and costs change significantly before the order is fulfilled, WineCellar is entitled to adjust the agreed-upon price accordingly.

Prices are in CHF and include VAT. If the customer does not pick up the merchandise at the WineCellar store, delivery charges will be billed separately.

Payment Terms

For online purchases, payment is processed through SIX Multipay. In all other cases, payment is due in full without discount no later than 30 days from the invoice date. After this period, WineCellar is entitled to charge late payment interest at the statutory rate without the need for a reminder or formal notice. Any amount due may only be paid to WineCellar employees or representatives if they have been authorized by a written power of attorney authorizing them to collect amounts in the name and on behalf of WineCellar.

Goods delivered by WineCellar remain its property until full payment has been made. The customer authorizes WineCellar to register a retention of title in the registry, at the customer’s expense. WineCellar reserves the right to make deliveries only upon prepayment or cash on delivery.

Delivery

Delivery times are up to 5 to 6 weeks for wine coolers and up to 10 days for other product categories. If a delivery timeframe or date is not met, the customer must issue a formal notice to WineCellar and grant it an additional period of time to complete the delivery. A delay in delivery does not entitle the customer to cancel the contract or to claim damages.

Shelves, storage units, and accessories are shipped via mail. Wine coolers will be delivered by WCD’s delivery service, unless the customer chooses to pick them up in person at the WineCellar store.

If the delivery is made by a carrier to the customer’s home, and if the carrier is unable to schedule a delivery appointment with the customer or if the customer is absent on the agreed-upon delivery date, the products will be returned to WineCellar. In this case, a new delivery date will be scheduled, and any additional costs will be borne by the customer.

Installation, Commissioning

Unless it has been agreed that WineCellar will handle this upon delivery, the installation and commissioning of the products are the responsibility of the customer, who agrees to strictly follow the installation, commissioning, and usage precautions specified in the corresponding product sheet, which is available on the website www.eurocave.swiss.

Warranty

Products sold by WineCellar are covered by a two-year warranty. If, despite all the care taken in their manufacture, a product should prove to be defective, WineCellar agrees to repair it as soon as possible or to provide an identical or equivalent replacement product, to the exclusion of all other legal rights and any other liability. In particular, WineCellar shall in no event be liable for any consequential damages resulting from a defect, including, but not limited to, those arising from the loss, destruction, or damage to goods stored in a wine cooler, on shelves, or on other furniture items delivered by WineCellar. In the event of a breakdown or defect in a wine cooler, it is the customer’s responsibility to ensure that the goods stored therein are maintained at the temperature necessary for their preservation, if applicable, and WineCellar disclaims all liability in this regard. The warranty does not apply in cases of normal wear and tear, failure to follow installation or usage instructions, or improper use. The warranty is also void in the event of any intervention (repairs, modifications) by a person not authorized by WineCellar.
